Reimbursement of Out-of-Pocket Medical Expenses
I have full custody of my 8 yo daughter and have been trying to get reimbursement of outstanding medical expenses from her father. He, and his attorney, have received copies of all the bills and I have met the first $100 responsibility stated in my divorce papers. Last May, my attorney filed several motions with the court, failure to reimburse me for medical bills was included. An agreement was reach which stated that he would reimburse me all past due medical bills within thirty days of the order being executed. It has now been 60 days and my attorney tell me that he ''can't file'' a motion for contempt because it doesn't make sense from a $ standpoint. Understand that I have spent over 40k in attorney fees (divorce and post divorce litigation) and my ex-husband seems to get away with violating court orders and never has to pay the consequences for his actions. What options do I have?

You have to decide if the total amount of medical bills is going to be substantially more than the attorney's fees that you're going to incur in bringing the motion. Otherwise, it's going to cost you more than its worth. Even if the court finds him in contempt for failing to pay, the court is not going to order him to pay right then and there, but will give him some time to pay. I do not believe that however long he delays, that he will be in danger of going to jail. Unless you're talking about 5 figures, it's not worth it.
