Legal Question in Family Law in Ohio

name removal from property

As a result of a dissolution two years ago, my ex husband gained control of our home, because I could not afford it and I did not ask for spousal support. He has since not gotten my name removed. If he tries to remove my name now, can I receive half of the equity? I did not sign a quick claim deed and we were married almost eight years. Thank you for your time and response in advance. Sincerely, Carrie

Re: name removal from property

It depends entirely on the language of the dissolution decree. If the issue of spousal support is not foreclosed, you may ask for it now, if you can prove the inequity. As to the house equity, you can try for it, but it should have been addressed and divided in the divorce decree.
