Revoking Parental Rights
My ex-husband was removed the home due to domestic violence. I then filed for divorce. During the removal of my ex's belongings from my apartment, I found a collection of my daughter's dirty underwear. At the final hearing of the divorce, the judge ruled that he had to receive counseling and start with supervised visitation. Child support was ordered. Since the final hearing in December of 2000 he has made no effort to do any of the things the judge ordered nor has he paid a single penny of child support. In October of 2001 he sent a death threat in the mail against myself and my oldest daughter. He was once again arrested for domestic violence. I want to know if I can have his parental rights taken away. He hasn't seen his daughter in almost 2 years. I would like to make out my will and I would want to name my neice to raise my children if something should happen to me. I want to make sure he can't come back and try to take her away from neice if I should unfortunately die. Thank You.

You can file to terminate all visitation rights with the child based on the facts you state. You may not want to terminate all parental rights in case he "wins the lottery". If you get a new significant other maybe that person can adopt the child and that will terminate all parental rights the former spouse may have.
