Legal Question in Family Law in Ohio
Rights if not on birth certificate.
A child is born out of wedlock. For the last 4 years the parents have lived together and raised the child together. Father is not on the birth certificate.
The parents are now splitting and mother wants to take child to New york.
We know father needs to establish paternity in order to stop her. Meanwhile what can he do? Can he file for emergency hearings? And once thats established... then is it prosumed that they both share custody, or because they were not married she automatically gets physical custody. Will dad have to pay back-pay in child support even though he has lived and raised child with mother?

There are a lot of issues here within your question. In order to answer them I would need all of the facts. It appears that the father does have some rights but he needs to get paternity established. You will definitely need an attorney to help you sort through the issues and to assist you in the court process. Feel free to contact me for a free consultation.
