Does he have rights as a dad/no paternity astablished?
My daughter and sons father and i aren't married. We are splitting up and he has threatened to fight for custody of our children. His name is not on my sons birth certificate. Can he take him from me? His name is on my daughters birth certificate, but since we aren't married they said he would have to sign proof of paternity papers, he never did...can he take my daughter? Thank you.

Until paternity is established, the alleged father is considered a stranger to the children and there is no way he can take the kids or even have visitation until paternity is estabished. If you initially have the kids, the Court will be extremely reluctant to transfer custody to the alleged father unless there is something extremely wrong with you such as violent temper or drugs.
