My rights in a divorce.
I live with a husband with a temper and he has never hurt me but verbally says things to me all the time. I think down the road we will end up in divorce. I am currently 8 weeks pregnant and have two other children under the age of 4. I will not stay married to this man forever. I was wondering what my rights are as a stay at home mom with 2 or 3 kids. If we do get divorced? He makes pretty good money but has a tendencey to have a violent temper even with our children. He has never hurt them? I wondering what I need to do to protect myself and try to prove him a violent person with a temper? Should I start taping our conversations or what. I am afraid he will take my children away from me if we get divorced. I do have a degree from college and can get work pretty easy if I try? I am just worried it would be a messy divorce. Do you think I should talk to legal counsel to see what my rights are?

In a situation such as yours, there are several thing to consider and it is important to contact counsel. Should you decide to get a divorce, the Court will give the custodial parent child support equal to 25 to 35% of his gross pay. Alimony will be awarded approximately one year for every 3 years of marriage. Finally, domestic violence can occur mentally as well as physically. If he threatens you then that is considered domestic violence. A domestic violence conviction will go a long way to making sure that you get custody of the kids and may even set him up for supervised visitation.
