Legal Question in Family Law in Ohio

Do I have to sell my house if I divorce?

My husband and I have agreed to divorce but he is insisting that we sell the house we own and split the money. Only problem is, we just purchased the house (a new build) and only lived in the home for 1 yr therefore we probably don't have any equity. I will keep both of our minor children and want to keep a stable home for them. I am the breadwinner and can afford the home on my own, can he make me sell if we have no equity. I live in Ohio and don't know the laws but I've read several divorce decrees that state whomever keeps the home has 1 yr to refinance in his/her name and other party will do quit claim deed to be removed from title. Also, we've been married for 7yrs and since I am the bread winner, can he insist that I pay him alimony? Please advise on what I can do.

Re: Do I have to sell my house if I divorce?

You and your husband will both be entitled to an equitable share of the marital estate. This may or may not involve selling the marital home. It's possible that you'll be able to negotiate some other method for dividing the estate that won't involve selling the home.

The question of spousal support will involve a more detailed discussion of your individual situation than is possible through this forum and, as such, you should consult with an attorney on this matter.

I would be happy to discuss this situation with you. Feel free to call or email to schedule a free initial consult. Good luck!
