Separation Agreement/Award Distribution

Can you just file for a legal separation without actually getting a dissolution? Will everything in the agreement be enforced to include the ''distributive award'' There are no children and no assets (he was financially negeligent, was fraudralant and lost over $100,000 I had received on first divorce settlement), therefore going after the ''Distributive Award'' to be deducted from his income monthly. Any suggestions?

Yes, you can. In a legal separation, all property and debts are divided, spousal support, if any, is divided, and all rights and duties are determined, but the marriage itself remains intact, and the court retains continuing jurisdiction over its order.
