Legal Question in Family Law in Ohio
sign bith certificate gives custody
I had a foster child whos mother was a known prostitute and still legaly married. The person who signed the birth certificate is her suspected ''pimp'' and not a good person. For what ever reason the magistrate decided to give her to this man without a paternity test. It stands to reason that a paternity test should have been issued first in the best interst of the child due to background circumstance. on top of all that this it the second case for this family the first time they forced a paternity test and he was not the father this time they did not. This named father is also married to a third party who is also not a very good person and she herself has lost custody of her own children. Is there something that I can do as an advocate for the child to force a paternaty test to get her out of that home. Also there is a biological aunt in the picture that has custody of the five other siblings the mother has had. Any information you can give to help will be apprieciated. The child (3mnths) needs or help, PLEASE!

Re: sign bith certificate gives custody
There is a Franklin County foster care hotline at Jobs and Family Services. Even though the may have recommended placement, I would start there again. You do have a right to intervene in this placement with information you have in juvenile court, but you will have to bring evidence to the court's attention.
