"Sole" custody would probably not be the best wording. Better to think that mom usually is designated by the courts as the "primary" custodian or "residential parent" with biological father, and perhaps his family, retaining visitation rights as set by the court. However, that is certainly a matter for the courts to decide based on all of the factors that go into looking into the "best interests of the child". I am in the middle of a case right now where I represent mom, who has been the "residential parent" of the 8 yr. old boy since Day One, but now Dad wants to be the residential parent and has filed a Motion for Change of Custody. These decisions are inherently fact-based, depending on the facts and circumstances of each case. GOOD LUCK!
