Legal Question in Family Law in Ohio
My sister in-law lives in OH. She is thinking about divorce. They have 4 children, 11, 3, 2, 2. Her husband owns his own business, and she is a full time mom. Before she takes action to get divorce. She wants to know if state will require her husband to pay min child support if he says the business is not profitable.
Secondly, if he says they have debut after married, will she be responsible for the debut as well?

A support order can be put in place based on historical earnings and an arrearage may indeed accumulate due to nonpayment. Eventually under these circumstances, he would be well advised to address a substantial arrearage lest it rise to the level of felony nonsupport. If he were to be charged with such a crime, he could spend some time in jail.
As far as marital debts, those will be sorted out along with marital assets in the divorce.
