Legal Question in Family Law in Ohio

Spouse's substance abuse

I recently found out that my husband has been a ''chronic'' (his word) cocaine abuser. I thought he just needed to budget better, but turns out that's where our money's been going. We have 4 children and I am a stay-at-home-mom so I do not generate an income.

I would like to know what, if any, legal rights do I have to his paycheck? Can I sue him for support while we are married and living together? Can I require drug testing? (He claims to now be clean.)

I just want to make sure that my family is provided for, and that I know where our money is going. I want to make him realize that he cannot continue to live like this.

Thank you for your help.

Re: Spouse's substance abuse

Yes, you can file an action for spousal and child support only, but a divorce is probably necessary, at least to get him to his senses. Once you have a support order, it would come directly out of his paycheck before he even sees it. You cannot get drug testing as part of a support order, but visitation could be conditioned on drug treatment for him.
