Legal Question in Family Law in Ohio

Can someone be sued for bad placement of funds?

At age eleven or twelve I was appointed a guardian at litam during visitation hearings. When my dad had to pay money it went straight to this attorney. He decided to put half away and give the other half to my mom. I am now eighteen and trying to get the money out. I have found that he put the money in stock accounts, and in the last almost two years I have lost over fourteen hundred dollars. Was he by law allowed to put my money in an account where I could lose money. I haven't spoken to him in this time so I never received statements as to how much money was in the account. He never told us I could lose money. Is this o.k. for him to have done. Thank You for any help you can give me.

If the attorney placed the funds into an account which was speculative in nature, then he may have breached his duty to the ward ie., you. One remedy would be to send a letter to the bar association complaining about this action. You may also take him to small claims, but you should do your homework beforehand and determine what duties the guardian ad litem has. I would look in the probate code in the guardianship area.

GOOD LUCK!!!
