Termination and Adoption

My husband wants to adopt my 8 year old son. We live in Michigan and my ex husband lives in Ohio. If my ex agrees to the adoption, what process do I need to go through. If he doesn't, what criteria will the court look for in determining to terminate his rights or allow the adoption without his consent? He hasn't seen our son is over a year and a half.

Step-parent adoption is a fairly easy process. You should consult a family law attorney to handle the process for you.

Or you can contact the adoptions unit of the County Court where you live to get a copy of the adoption packet.

If the biological father does not consent the court will terminate if he has not paid support in 2 years and has had no contact with the child for 2 years. That's the easy answer. I would be happy to discuss this in more detail.
