Legal Question in Family Law in Ohio

Transfer of property after divorce?

Four months ago I divorced my wife of four years. After we were married, we purchased a house together. In the divorce, it was agreed that she would retain the house. She has now decided to move out of town and has offered the house back to me. Can we file an amendment to the Divorce Decree that states the house is mine as part of the divorce? I know we would have to execute a new quit claim deed and I would have to assume the mortgage. Will courts generally allow a modification to a Divorce Decree after-the-fact if it is agreed to by all of the parties?

Check your separation agreement. Often they are not modifiable through the , but the parties can agree in writing to modify the terms. If this is so, then put this agreement in writing and follow up on the rest.
