I left my boyfriend about 2 years ago and at the time my daughter was almost 12 years old. We decided that she was going to live with him. We never went to court, so there are no custody papers drawn up. Now that my daughter will be 14 she is no longer getting along with her father and wants to come and live with me. I need to know what my rights are. I would love for her to come with me to live but I don't want the police knocking on my door telling me that they have gotten a call that I have kidnapped her. Please help me.

In the absence of a custody order issued by a court, as mother you have a paramount right for custody and control of your child. If you want to regain possession, I would go over there with the police, and a certified copy of the birth certificate. I would then immediately file a custody motion in the juvenile court to determine the respective parental rights and visitation.
