Legal Question in Family Law in Ohio

Unnecessary medical

I have been divorced for 10 years. I pay my support on time and cover medical insurance. I also see my boys regularly. I've always had issue with my Ex for the way she has handled medical issues. Instead of taking to the doctor for cold/strep throat, etc., she takes to emergency room which means a significant difference. I have never complained and paid what was necessary.

Over the years, our financial situation has changed dramatically. She was originally calculated at 22,000/yr. me at 56,000. However, she now makes 52,000/yr and I make 62,000. After my child support and taxes are taken out, she makes over 10,000 /yr more then I do. I also have continued to pay day care for the last 3 yrs. even though my boys are old enough to stay home. I do this so they can afford their house. I have a new family and 2 children with my new wife.

Recently when I picked up my son, he had braces on. I'm not a D.O., but his teeth were perfect. He told me he only needed them for 9mos. because he had a few little gaps. My x did not consult with me on this issue. Our papers say she has jurisdiction over ordinary med. and D.O. visits, but that I should be consulted on major med/D.O. She is now asking for 1,500! Do I have to pay?

Re: Unnecessary medical

I would file a motion to review the medical situation, as well as to recalculate child support based on current income levels.

You describe enough 'changed circumstances' here for you to request the Court to approve a modification of your parenting plan and probably get it approved.
