visitation for special needs 22 year old

My stepdaughter is 22 years old and has Down Syndrome. Her father and I share joint guardianship of her. Her biological mother lives out of state and has since she was 14. We have set up some rules on when, where, and how long visitation occurs with her for our daughters safety. But she now wants to have her for a couple of months out of the year instead of a week here and there. We have refused this and she says she will now file in our state for visitation rights. Can she do this?
