visitation between states
My step son has severe apraxia and PDD. When my husband divorced his ex-wife he was ordered to take a parenting class and he did not because she told him she was the only one who needed to take the course. When he got the divorce paper work back his visitation was not defined. Now he has completed the class and wants to establish a visitation schedule. We live in Texas and our son lives in OHio. His mother does not want to agree to anything. It has been 3 years since he has seen his son and she wants him to wait for 2 more years. Can we file a visitation request and if the judge approves it then it is approved? Is there someway to get some visitation established without her having to agree. Would it be helpful to have my step son's mental health physician write a report which states what would be a good visistation schedule for him and his disability? Please any advice you have will be very helpful.

The courts prefer to see both divorced parents involved in the care of the child, particularly if this benefits the child. Any evidence you may have, such as a medical report, to support the father's involvement is a plus.
