visitation-how old does a child have to be to refuse to go with other parent?
i would like to know how old a child has to be in the state of ohio to refuse to go to visitation with the other parent. i have a 13 yr old daughter with my ex husband (we've been divorced for over 3 years). he is supposed to get visitation on weekends from 10am to 7pm. i've been pleasant to him only for our daughters sake, and when he found out i wasn't getting back with him, he blew up at our daughter and is telling her she's going to be with him every weekend no matter what. she came home crying and saying she doesn't want to go due to the abusiveness. he has been accused of child molestation several times but never charged due to lack of evidence (the victims are all adults now). i'm terrified he has done something to my daughter or will. he's very abusive but no one will believe me due to a ''lack of a paper trail''. there is no phone because he would break it everytime we had a fight, then threaten me or my children. i'm scared of this man and i don't want to put my daughter in jeapordy. please help

This is a matter to take back to court to modify visitation. You could request supervised visitation at this time. A guardian ad litem might be appointed to interview the child and check out both parents' residences to make a report to the court.
