Legal Question in Family Law in Ohio

My wife told me to leave and we have a 1 in a half year old son and neither one of us as custody of him. There has been no legal separation no divorce papers file or nothing and I was wanting to know as his dad what rights do I have with him. I would also like to know what rights that my mom would have to him as his grandma because she has raised him from day one. I would also like to know that if I would if I would get him for a visit would I have to take him back if he didnt want to go since no one has no custody of him....

You would need to file for divorce and also ask for a temporary order of custody between you and your wife. The grandmother does have rights to she her grandchild.

If you need an attorney I would be happy to represent you. We could have the divorce papers filed by next week.

Feel free to contact me, free of charge, at [email protected] or at 330-447-7634. I am happy to help in any way that I can.

Thank you and I look forward to hearing from you.

I suggest you begin the process of divorce so that your parenting arrangements will be established early on in the child's life and, if there are future issues over parenting, you will have the court order to support what happens.
