Will I be able to get custody?

My situation is a little odd. My husband & I split up over a year ago. Me and his mother have had shared parenting almost the whole time. Now she is ill, and can't take care of my children as much. So, they have been with me. My husband has seen them possibly 3 times in the last 3 months. He also does not have his own place. I just bought a mobile home for me and my kids. I have been seeing someone for about 8 months. A couple of days ago we got into a heated argument, (the kids were not here) and he hit me. He has never done that before. My question is, will this cause me problems when I go for my divorce May 15th, even though it was a shoe-in that I would get full custody before this happened? Thank you

First of all this answer is probably moot since the hearing was May 15 and this is now June 9. I hope that you still got custody.

Now my answer!!! You should still get custody as your environment still appears to be superior to you husbands. However, should the domestic violence come out, there may be some conditions set forth as to the contact with your boyfriend and the child. Assuming that your boyfriend was charged with domestic violence, the criminal Court will insist that he attend and complete counseling. At the very worst the court will give you a choice either your boyfriend or your child.
