Legal Question in Medical Leave in Ohio

Employer requesting Family Medical Leave Act of employee

My husband has been to the doctor

several times with back pain. His

doctor writes excuses limiting what he

can do at work. On Friday, my

husband's boss called the human

resourses department requesting that

my husband be put on Family Medical

Leave Act until his back is healed. Can

an employer do that to an employee,

and is the employee still covered under

the act with his job being held open for

him until he returns? What legal

recourses does my husband have open

to him, if his employer fires him while

my husband's claim is being worked on

by the company that provides Family

Medicatl Leave Act to the company that

my husband works for?

Assuming his company meets federal qualifications under the Family Medical Leave Act (FMLA), they would have to hold his job for up to 12 weeks. If they fire him, he can seek damages under federal law. If you need additional assistance, you may contact me via email. Best of luck!
