Legal Question in Medical Leave in Ohio

My wifes employment was terminated over the phone due to her calling in to care for sick daughter for a second day. Although she did not request FMLA it was not even an option given her. Their statement was that they did not ''feel'' her attendance was worthy of a *** employee. She has also called in past due to my serious health condition again going against attendance and no option of FMLA given. When she asked about her inquire was blown off. Do we have recourse to get her job back or at least make employer accountable for FMLA as my wife states it does not seem to be an option given anyone. The company does meet parameters of a covered employer.

Re: Fmla

Usually you must request fmla thru HR. Fill out the papers have doctor complete. An emergency that is unforeseen is the exception to the rule.
