Legal Question in Medical Leave in Ohio

Taking FMLA after returning to work

I am a father of a new born. I took one week off when my child was born and used sick time that I had earned. Today I returned to work. I have family assisting the mother of my child with care for the next couple weeks. Do I still qualify for FMLA after already returning to work.

Re: Taking FMLA after returning to work

Not unless your employer agrees to grant additional FMLA leave. When FMLA leave is taken after the birth of a child, intermittent leave (leave taken in several segments rather than all at once) may be taken only if the employer agrees or if the leave qualifies under the FMLA for another reason, such as a serious medical condition of the mother or child.
