Legal Question in Medical Leave in Ohio
vacation and sick pay
My employer is wanting to make me take my earned vacation and sick days instead of my unpaid FML so I can take care of my 10 year old daughter whom just got diagnosed today with Scarlet Fever. Now she is not allowed to leave the home, no school and needs to take her medication several times a day. This is highly contagious the doctor informs me tonight. Can they really make me take my earned vacation days and sick days to take care of my sick child? I really need to have some questions answered before I sign any papers. I work hard for those earned days and children do get sick at the drop of a hat without warning signs-as in my daughters case.
Thank you.

Re: vacation and sick pay
Yes, in your case, the employer can require that accrued paid leave and FMLA leave run concurrently. If you are a member of a union, however, the employer's FMLA policy should not conflict with the collective bargaining agreement.
