car accident - insurance issue

Last July we were involved in a hit & run.

Ms M crossed the yellow to get to a left hand turn lane without having to wait in rushhour traffic almost hitting us. When we got to the light next to her we told her and that she needs to be careful. She got out of her truck and came around the front when my husband and a friend got out of our car. She got back in her truck & we left. She cut into our lane 2 cars behind us, crossed into oncoming traffic, passed us, & started rocking her truck by hitting brakes then gas until we & others held our horns. she made as if to go left, we tried to get around her & away from her quickly when she slammed on her brakes and we hit her. We chased her between lanes (two way traffic) during rushhour, through empty lots to get her plates. The officer filled out the wrong report and there has been no criminal prosecution that I know of. Can we recover the $2200 for damagaes plus $350 for the junk car ($500) that got us around until we sold it for $150, if we were not insured at the time? I don't know if she was, we can't find her. Last I heard the police had a new phone number for her, but no address. Do I need to find her before we file? What is my statute of limitations?

The statute of limitations is two years from the date of the offense so you still have time. You need to find her address and even if you can't you can still sue.
