Legal Question in Civil Litigation in Ohio
If my car insurance refuses to settle a case for an amount requested that is less than my coverage and goes to court where the jury awards more than my coverage, can I sue the insurance for the additonal amount for not settling?

In a nutshell, yes. If your insurance company could have settled your case within your policy limits, doesn't do so, then you get an "excess" verdict which is more than your policy limits, you have a "bad faith" claim against your insurance company. The strength of your claim, however, is a different matter.
