damage to 2004 reefer trailer

my trailer was damaged by company forklift operator while unloading, is the company liable and how do I get compensation?

From what you have given, it sounds like the company is liable. Unless you can reach an agreement, you will have to sue.

I'd need to know more to advise you properly. Was the forklift unloading the trailer? How long ago did this happen? Did you have a written contract with the forklift operator's company? Do you have insurance on the trailer?

In order to get compensated, you have to figure out who injured you (or your trailer) whether that person had a duty to not injure your trailer, whether they breached that duty, whether the breach was the proximate cause of your damages, and you have to have damages - it has to cost money to fix.

This is a valid reason to set up a consult with an attorney. Look for one that does consumer protection and/ or contract issues, and who can handle litigation.
