Legal Question in Civil Litigation in Ohio

Damaged property

We have a landscaping company and we were mowing an apartment complex. Someone called and said we broke a window. A large piece of tree trunk broke this lady's window. Earlier in week the apartment place had trees cut. We paid for window and now 2 weeks later the lady says she has glass in her king size bed and we need to buy her a new one. What do we do? Are we liable?

Re: Damaged property

Dear Landscape Contractor: In my professional opinion, under the facts stated and based on Ohio law, NO, you are under no obligation to pay for the lady's bed! You really should not have indulged your customer by paying for a broken window, since no act of yours caused the window to break.

I suggest you retain regular, experienced counsel, available to answer your questions BEFORE you pay our hard-earned money.

Good luck.
