Legal Question in Civil Litigation in Ohio

Downspout drainage

We've lived in our current house in rural Jefferson County for about 27 years. From the time we moved in, the sump pump and one downspout has drained into the side yard and then into the downhill neighbor's yard. The current neighbor has lived there for about 20 years. This summer he was having trouble with water in his basement and installed an extensive system of drains. He's now demanding reimbursement from us for the cost. At no time prior to this did he approach us concerning his problem or ask us to rectify the situation, either on or own or in a cooperative fashion. Since we have made no changes to the drainage in the last 27 years, we believe we are not liable for any of his costs as the situation existed when he bought the property. Are we liable for any part of his expenses?
