Internet Bulletin Boards
Can an attorney use false statements and fear tactics to get a person to cooperate. I have a friend who has been accused of posting unflattering messages on a Yahoo bulletin board. An attorney for the subject of those postings has told my friend that they have proof that the postings came from her computer and that Yahoo gave him that proof. He has furthermore threatened her with jail time if the postings are not removed. Yahoo say they do not give out such information without a subpeona. I have also been told that such postings are covered by free speech unless they are slander, which thses are not. They are just unflattering to the clinic involved. There is a separate issue about an account created by my friend that the attorney has now claimed is a business account and belongs to the clinic, even though my friend created the account. The clinic and the attorney broke into that account and when my friend complained she was threatened again by the attorney. She has since taken action to close the account entirely. She was threatened for that action too. I believe the attorney has acted in an illegal and unethical manner because he knows my friend is not very educated and poor and can't afford an attorney.
