Legal Question in Civil Litigation in Ohio
Can a member of an online forum sue the site owner for not letting them delete their account?
1 Answer from Attorneys
Dear Inquirer: Whether you may require (or compel) the owner of an online listserve to permit you to de-list yourself will depend entirely upon the specific provisions of the original listing agreement. If there are actual provisions for de-listing, you may be required to conform with those specifics. If there are none, you may have to retain counsel to prepare a tough letter, followed by an appropriate legal action.
But, above all, please consult and obtain the advice of experienced counsel. and provide him or her with a copy of all of the terms of agreement, if any.
Good luck!
sincerely, J. Norman Stark, 17000 St. Clair Avenue, cleveland, OH 44110-2535 Tel.: 216-531-5310 Ext. 22. Email: [email protected].
