Legal Question in Civil Litigation in Ohio
Neighbor nuisance
I live in a rural part of Southeastern Ohio in a development that's under county jurisdiction. A little over a year ago, my neighbors cleared the wooded area behind their house and created a motorcross track for their 13 year old son to race his motorcycle. The motorocycle(s) are so loud that we can't keep our windows open or sit on our deck in the warmer months without enduring deafening engine noise. Not to mention the dust and exhaust that come along with it. Now we have a 10 month old baby and I'm concerned that she won't be able to nap without closing the house up each day. I haven't approached these people as their completely unreasonable and I know the response that I'll get if I do. I've discussed this problem with the homeowners on the other side of my nuisance neighbors and they feel exactly the way I do, as does anyone else that I discuss this with. Are there any legal options that I can pursue to put a stop to this nonsense?

Re: Neighbor nuisance
Dear Annoyed: Contact your County Building Department, report what you believe is a violation of the building code, and ask that an Inspector come out during the "races" to observe what is goping on. I believe he may issue a citation which will require your noisy neighbors to shut down the track and cease using it for the annoying sport.
The other option is to sue for vilation of your right to peace and quiet enjoyment of your property. But, that's sure to cause a real rift with your neighbor.
Good luck. Sincerely, J. Norman Stark, Cleveland, Ohio
