Legal Question in Civil Litigation in Ohio

repair costs

We had new brakes put on semi trailer locally by cert diesel mech. 1000 miles later, a wheel came off at 70mph on Interstate 70 in traffic. No one was hurt or killed thank goodness. However, the cost of the repair was double the brake job. We never did find the first wheel, but the 2nd one that also came off while getting off the interstate ramp, was totally destroyed. The local mech said that he'd stand by his work and reimburse us, but now is saying that we have no proof that this happened, even though we gave him the receipts. The mechanic at the TA that fixed the problem on the road said that in his opinion, the wheels came off because the lugnuts were not torqued down completely. There was nothing wrong with the 2nd rim expect the holes for the studs were wallered out, therefore had to be replaced. The incident has set us back financially and made us very paranoid. My husband has been driving commercially since 1989 and never has lost a wheel. What should we do?

My best advice is to make an appointment to speak with a lawyer. You may have a claim against the brake mechanic for his workmanship which the lawyer can help advise you about and proceed on your behalf with. A case such as this might require interviewing and taking statements from witnesses, analyzing police reports, and dealing with insurance companies, all of which a lawyer can help you with.

You could probably file suit for all your expenses, including the roadside fix, any lost wages, all incidental, and for any personal injury. I would need to talk to you to determine if there is enough evidence to proceed. If you are interested, call for a free consultation.
