Legal Question in Civil Litigation in Ohio

Small Claims Court Change of Venue

I am being sued by an ex-boyfriend in small claims court who says that the things be bought me and bills he paid for me were ''loans.'' He has even kept my property that was at his house, claiming he would not return the items until I paid him back. He is upset that I broke up with him. I never borrowed money from him. He lives in the venue in which he filed the claim, I do not. The things he bought me and the bills he paid were not of that venue. It is a small town court where his mother works. He knows everybody in town. I called the court and asked for a form for change of venue and a worker said she didn't think i could do that. I want to get this case moved. How do I do that? I am also looking for reasonably priced legal represenation (No one listed at your site). Time is of the essence. Thank you.

Re: Small Claims Court Change of Venue

Jurisdiction lies either where the Defendant lives or where the cause of action occurred. Therefore, where he lives may be the proper venue. It is up to you to show that the items were a gift and that he intended to part with the items and transfer them to you. Did any one hear him talk about the items. If so, they can testify.

Good Luck!!!
