Legal Question in Civil Litigation in Ohio

Statutory Rape

I was physically, mentally, and emotionally abused by a man 11 years my senior when I was 14 years old. I have suffered since; now 34 years of age but I remember like it was yesterday. I was physically (with scars to prove), emotionally, and mentally abused. I have recently had plastic surgery to restore my face as a result. I feel that I have also suffered greatly emotionally. I have a history of violent and emotional outbreaks which I believe began with him. There are many things I could mention; but the one thing that stands out the most is that this man was charged but not convicted of statutory rape involving me in Delaware County Ohio. He has not been held accountable, and may have harmed others as well. I have found that he was charged with Domestic Violence in 1992; many years later. What can I do to get restitution, if it can be done?

Re: Statutory Rape

Your situation is most unfortunate. What you have described has a definite civil remedy (tort), but there are time limits on pursuing such a claim. For example, in Ohio, there is a one-year time limit for a lawsuit for assault and battery. That seems to be the primary description of your claim. Unfortunately, because of the passage of time (20 years) and the man's prior conviction many years ago, relating to you, you may not have a legal remedy. Please have the exact facts reviewed by a lawyer in your vicinity, as there may be other circumstances that you have not revealed.

Best of luck,
