What's the next step after Judge overrules motion for Preliminary Injunction?
Our company was sued. We finally had a ruling two years later. The Court overruled the motion for a preliminary injunction. The judge ruled strongly in our favor on every count. We want to do a ''mutual walk away''. Even though we won, we don't want to go forward with our counter suit. We just want to end this thing. There is enough business for everyone. We told our attorney on five ocassions to make the offer--whatever it takes just to end it. The othe side a right to a trial by jury. We're not sure where they stand. Our attorney will not call and offer a mutual walk away. He wants us to move forward with our counter suit. He wants their case to go to trial--we do not. We're too afraid to fire him..it's been going on too long. What do we do? He mentioned a Summary Judgement in one of the MANY phone conversations since the ruling last October. The judge even mentioned to our attorney in his ruling that his strong judgement should ''end'' it. What do we have to tell our attorney just to end it. We don't want our legal fees recouped. We just want to end it.

Your attorney should follow your request. You should schedule a meeting with him and send a letter to him demanding his efforts to facilitate a resolution. If he continues to refuse, you need to seek new counsel.
