Vehicle storage fees on private property
I totaled my car in Sept. 2008, and
did not have insurance at the time. I
had my car towed to our local
collision repair where it is has been
since the accident. I chose to not
repair the vehicle, as it would cost
more than I owed on the car. The
collision center offered to buy my car
for $1800, but I could not sell them
the car until until the $11,000
balance on my car loan was paid off
to get the title. I paid off the car 2
weeks ago, and went back to the
collision center to give them the title,
and sell them the car. Now they are
saying the will give me a $100 and if
i don't sell it to them for a $100 they
will charge me a $15/day storage fee
for the vehicle since September. Can
they do this? I never signed anything
agreeing to a storage fee. The only
document I signed was for a free
estimate of my car's damage. And at
the same time I have also found out
that they moved my car to another
location and have started to take
parts from it, without my permission!
Can they charge me a storage
fee, even though we never agreed on
it? Can they repair/work on/move my
vehicle without my consent? Can I
just go get my car?

You might have a case. It is perfect for small claims court. You don't need to pay an attorney and the filing costs are very small. Best Regards, Edward DiCato
