Firing My Lawyer and Contingency Fees
I was in a horrible auto-accident in 2003 that was the fault of the other driver. I nearly died with several life-threatening internal injuries, ended up with a C1-C2 fusion and a broken sternum that shifted, moved upward, never repaired. I hired an attorney in Nov. 2003 to advise me, paying him an hourly fee. In March of �05 I hired him on a 25% contingency fee plus expenses. He�s performed poorly. I�ve been through a deposition in which he never gave me the interrogatories to sign until the day we are at the table doing out depositions. We attended mediation, the same thing happened with the mediation summary. He had one of my medical conditions wrong. The trial date is December of 2006; no way is he ready for jury trial. I went in to fire him. He says he will turn over our files to another attorney, but says he is owed a percentage of what the other lawyer's percentage. I do not feel this is fair since he has not done the first deposition on my behalf, gotten statements from my doctors, talked to witnesses at the accident or anything that should have been done. I want him to total his bill and give me my files. How do I go about just paying him for the leftover expenses and his time at this point?

What exactly does the contract with the first attorney say about this situation? Have you discussed the matter with your new attorney?
