Legal Question in Health Care Law in Ohio
Medical Disclosure
My husband was diagnosed with HIV almost 2 years ago. His ex wife works in the hospital that he was in. He hadn't spoke to his children (from another marriage, not this ex wife), for over a year. He just spoke to his son today, and his son told him that his ex wife told them he had AIDS and that she has paperwork to prove it. We have chosen to keep this information to ourselves. He found out today that his daughter (not from this ex) has a 2 month old daughter. My husband was very close to his children, but we now know why they haven't spoke to him in over a year. Is there anything we can do to his ex wife and the hospital she works at? This has to be a violation of the HIPAA or something. She has ruined his relationship with his children and no telling who else knows this extremely private info.

Your husband may have a legal cause of action against his ex-wife and also the hospital. Additional facts and investigation would be needed to be sure how best to proceed. Violating your husband's patient privacy is a very serious offense.
