Legal Question in Immigration Law in Ohio
Deportation
My boyfriend of 8yrs has been charged with medicaid fraud, and money laundring both charges are Federal charges. When he was indited he was not in the US, he was in hometown of Liberia. When he came to face the alleged charges, the immagration put a detainer on him. He does not have a crimmanal record. We have 4 children, 1 being biological. Will they release the detainer? Or can you give me advice on what to do?

He needs to go through the criminal justice system. Depending upon a finding of guilt or innocence depends upon whether there will be a deportation hearing.

Is your boyfriend a lawful permanent resident, and has he been convicted yet of anything? These charges will definitely have an impact on his immigration status no matter what his status is. Therefore, before any trial or guilty plea, he must have his criminal lawyer consult with an immigration lawyer to see what the impact of a conviction is on your boyfriend's immigration status. If he has no criminal record, how the heck did he get involved in these charges? Make sure he has a good criminal lawyer to fight for his side. My office does consultations with criminal lawyers on just these issues. The charges he faces are very serious and could have very bad consequences for his immigration status. I have a few questions for you though. Has he been convicted of these charges you mentioned or what happened to these charges? Is he still going to be tried for these charges because if he is he needs to get an "excellent" criminal lawyer to defend him. That lawyer should also be in touch with an immigration lawyer before anything is done on the criminal charges; especially any plea agreements. Also, what status does your boyfriend have in the U.S.?
