Legal Question in Immigration Law in Ohio

green card options

Hi, I had two questions on which I would really appreciate your help.

1. If I have 1 year left on my H1-B visa (i.e. I have used up 5 years) and I find a job where the company is willing to sponsor me for green card can I keep working in the company till green card is approved?

2. What options are available for me to keep working indefinitely and apply for green card?

Thank you very much for your answers.

Re: green card options

Thank you for your email. You may file for permanent residency and extend your H-1B out for one year at a time until your labor certification/I-140/I-485 is adjudicated if you file before your sixth year begins in H-1B status. From your inquiry, it appears that you are already into your sixth year. It may be possible to recapture some of your H-1B time (if you delayed in entering the US, were abroad during part of your H-1B stay, etc.). I would be pleased to further advise you but would need these additional details. Please feel free to call me directly at 619.233.0900.

Sincerely,
