Immigrant Marriage
My boyfriend is a immigrant. If he becomes illegal will there be a problem with us getting married? I am still waiting for a divorce.

If you marry a person who falls out of status in this country and is still in this country, it is very difficult petition that person as an alien relative by reason of marriage.

The best would be if he could go home first and then you could get a fiance visa so he will not go out of status. Or he could come back on other visas and then you could get married.
