Legal Question in Immigration Law in Ohio
Need immigration advice
My daughter's boyfriend from Italy is here in the country and wants to stay here. They plan to marry eventually. He has applied for the diversity lottery but is here as a tourist at this time. Is there a way for him to stay here and work and/or go to school legally? How long can he legally stay in the country as a tourist? If he works without permission and get caught will it hurt his chances to naturalize later?

Re: Need immigration advice
It sounds like you might be mixing up issues. As long as he marries your daughter, he can apply for Permanent Residence, assuming your daughter is a citizen. He must be a Permanent Residnt for at least three years afterwards before he is eligible to naturalize. He cannot work in the states until he establishes legal status. If he is college educated and has an employer sponsor him for a professional job, I can possibly petition him for a work visa. Call me at my office in the morning and I will provide a quick consult. 408.293.2026
