i have been married for 5 years they will not give my husband a greencard and they will not give him a reason why is this legal

Assuming you went through the adjustment of status interview and that was successful, a very common problem with delays is the FBI background check that is done on every applicant of this nature. If this is the case, you probably will not be given a reason, except that the background check has not been completed.
