Legal Question in Immigration Law in Ohio

Some insight please

I applied as unmarried child under 21 back in 2006 thru my father's wife, who is a US citizen. I called the immigration about 6 months ago to ask why I never got my social sec # and they told me that there was no I-485 filed under my name. They probably lost it because I remember we did file it.

I'm getting married soon to a US citizen and a lawyer told me that I should close down the unmarried under 21 petition before I apply thru my husband. She says it's an ''easy, fast process''.

Did she give me the right info? How long should it take? Is it going to badly affect my new petition thru my husband? Please give me any insight possible. Thanks.

Hi,

You may want to consult with another attorney prior to "closing down" any avenue for an immigration benefit. The marriage to a U.S. citizen likely will confer status upon you (barring any inadmissibility issues), but it is always nice to have a back up plan.

It is important to never be "out of status." I suggest getting a complete record of your immigration file to before taking your next step. I also recommend that you consult with an immigration attorney.
