Legal Question in Immigration Law in Ohio
Status Change
I am an Indian student currently here on an F-1 Visa. I plan to marry an Indian whose K-1 Visa status has expired. Can he be changed to a legal valid status, as an F1 dependent post marriage?

Re: Status Change
No, he cannot change to F-2 dependent status inside the U.S. since his I-94 has expired and K-1s cannot be converted. If he marries you and returns to India for consular processing, he may come back to the U.S. as an F-2 dependent as long as he has not been illegal in the U.S. for more than 180 days.
