Legal Question in Insurance Law in Ohio
auto accident
I was in a car accident on 1\19\07. it was the other drivers fault. his insurance company tells me that the car is a total loss. i have a lein on it through a loan company and they are going to send the settlement to them. i also have full coverage insurance through the loan company. the insurance company representing the other driver tells me that i can only have one payout. either them or my loan company. is this true. also do i have to take the first offer they give me or will they go lower if i wait too long.

The insurance company is right. You can't be paid twice for the same loss. And, no, you don't have to take the first offer. However, if you were injured in the accident, you may want to hire a lawyer before doing anything else.
