Legal Question in Insurance Law in Ohio
Car Accident
My boyfriend was recently involved in an automobile accident; he was not cited, the other driver was. Luckily the other driver carried insurance. My boyfriend was instructed to take the car to one of the collision repair shops recommended by the insurance company. However, after estimating the cost of repairs to the car, the insurance company has decided to total out the car rather than repairing the car. Even after the amount the insurance company has agreed to provide, my boyfriend is left with $2000.00 + to payoff on his automoble loan. Is there any recourse for him to recoup the entire loan amount of the car? He does not have gap insurance with his insurance policy.

If he was injured in any way and has medical documentation of it, he could get additional money from his personal injury cliam for pain & suffering and use that money.
He could also sue the driver in small claims court for the balance as long as the release he signs from the insurance company does NOT release the driver from any liability.
